The lawyer of Mark Latham’s ex-partner says she was “distraught” following her dramatic Sydney Airport arrest that landed her in custody for a night.

Nathalie May Matthews, who has since been granted bail after a brief court hearing on Monday, was charged with accessing and modifying restricted data held in a computer, intentionally recording an intimate image without consent, and intentionally distributing an intimate image without consent.

Ms Matthews has not yet entered any pleas to the charges.

She spent Sunday night in Surry Hills Correctional after she was initially refused bail by police, with her lawyer Daniel Wakin appearing on her behalf in the Parramatta Local Court on Monday morning.

Her bail application was not opposed by the prosecution.

Mr Wakin, speaking outside court, said his client was “distraught” following the dramatic arrest.

“She was distraught, of course … coming home to find yourself arrested,” Mr Wakin said.

“Thankfully, we are in Australia … she was given proper treatment as far as the arrest process is concerned.

“I don’t imagine (custody) would have been as enjoyable as she would have liked, but in any event, I mean, it’s remand for a night. We’ve got her bail today, so I’m very thankful.”

Mr Wakin said the arrest was “pretty dramatic” but did not suggest these types of offences aren’t serious.

Ms Matthews will “defend herself”, Mr Wakin said, also telling reporters he had not seen any photographs or videos as none had been presented at this early stage.

Ms Matthews had to surrender her passport and must not apply for a new one as part of her bail conditions, and is not permitted to contact any prosecution witnesses except through a legal practitioner.

Police earlier said a 38-year-old woman was taken into custody over an outstanding arrest warrant.

The woman had arrived in Sydney from Dubai and was charged with three offences.

The fresh charges against Ms Matthews come after she applied for an aggravated violence against Mr Latham.

She alleged Mr Latham abused her during their relationship and forced her into degrading sex acts.

The court has not released the exact allegations and no criminal charges have been laid against Mr Latham.

He has denied the allegations.

The matter is set for a court hearing in May.
