A man has been jailed for raping his intellectually disabled adult half-sister and indecently dealing with his two younger siblings when they were children.

In Perth District Court this month, the 34-year-old-man, who cannot be named to protect the identity of the victims, was sentenced to 24 months imprisonment after admitting 10 charges.

The court was told throughout 2020, he and his partner at the time had an ongoing sexual relationship with his 22-year-old biological half-sister, who had autism and a “severe intellectual disability”.

The man, who is infertile, admitted to sexually penetrating his “vulnerable” sibling on several occasions — with the incidents not occurring in the Goldfields-Esperance region — which his partner, who has pleaded guilty but is yet to be sentenced, helped instigate.

Judge Craig Astill said the man had become his half-sister’s guardian and administrator after she was released from foster care.

The perpetrator claimed the acts with his half-sister were consensual, and that he never viewed the woman as a sibling, as they grew up separately.

The court was told about 12 years earlier, across 2008 and 2009, the man, who was 17 at the time and living in Kalgoorlie-Boulder, had sexually abused his other two siblings.

Between February 5, 2008, and February 7, 2009, the juvenile had lured his six-year-old sister into his room and asked for sexual favours, which she refused.

Judge Astill said the 17-year-old had called out to his sister while standing naked from the waist down in his bedroom, before trying to guide her to perform an indecent act.

In May 2009, the juvenile had indecently dealt with his five-year-old brother, while he was home alone, tasked with looking after his two siblings while his mother was out.

The court was told, the teen had crawled into bed with his brother and sister, asked them both to remove their pants, before directing the brother to perform an indecent act.

Mr Astill said the child followed his older brother’s directions as he trusted him.

“He did what he was told because of your position as an older brother and because you were the one that was in charge,” he said.

The judge claimed the man’s authority over the children was an aggravating factor.

“The fact that your mother entrusted you to look after your two siblings and you abused that trust is something that I do consider to be an aggravating feature of this offending,” he said.

“This was their home, which is a place where they are entitled to feel safe.

“You were their older brother; you were the one that was supposed to be looking after them.”

A pre-sentence and psychological report stated the offender had experienced sexual and physical violence as child from his older brother and father, respectively.

The man, who initially denied the offences when interviewed by police, pleaded guilty to the charges against his younger siblings on January 30, and those against his disabled half-sister on April 16, 2025.

His charges included seven counts of sexually penetrating a person over 18 who was a lineal relative, two counts of procuring, encouraging or inciting a child under 13-years to do an indecent act, and one count of indecently dealing with a child under 13-years.

He was sentenced while appearing in court via video link from prison, where he was 25 months into serving a 35-month sentence for other matters.

On top of his jail term, the 34-year-old was served a lifelong restraining order against his disabled sibling and prohibited from obtaining a firearm or firearm licence.

The man will be eligible for parole in 12 months.
