Influencer Haley Baylee faces lawsuit over ‘two coke can’ penis comment about NFL player ex-husband Matt Kalil
A court has found an influencer’s comments about the size of her NFL player ex-husband’s penis of ‘legitimate public concern’.
Retired NFL player Matt Kalil’s lawsuit against his influencer ex-wife Haley Bayley has been thrown out by a judge who found her “degrading” comments about the size of his penis a matter “of legitimate public concern.”
The former Minnesota Vikings offensive tackle served Ms Bayley with the lawsuit in January, following a November 2025 appearance on a podcast where she discussed how their marriage failure stemmed from intimacy issues due to the size of Mr Kalil’s penis.
Ms Bayley compared the size of Mr Kalil’s penis to “two coke cans, maybe even a third.”

“We’ve tried, impossible unless you’re going to be in tears.”
Amidst laughter with podcast host Marlon Garcia, Ms Bayley reinforced that from her perspective, the reason for the conclusion of her seven year marriage was the size of her ex-husband’s penis.
“That was the biggest factor … Love him, but he’s my homie … No, because he’s like .01 per cent of the population.”
In legal documents, Mr Kalil claimed his ex-wife’s comments caused “unwanted attention and invasive commentary from the public” and that his family has “been forced to endure the ongoing public circulation of these degrading and deeply personal statements.”
He also claimed that whilst he suffered public ridicule, Ms Bayley received financially beneficial public engagement.
The influencer retaliated to the claims, arguing that the court should dismiss the case due to her comments being a truthful, autobiographical account of her own marriage and life experience.
The case was dismissed when it faced court on Thursday, with the judge finding Ms Bayley’s comments of “legitimate public concern.”
“The Court finds that Haley’s remarks about the size of Matt’s penis and its impact on her health and marriage were remarks about a matter of legitimate public concern,” the judge deemed.
Ms Bayley spoke to TMZ after the case was thrown out, saying she is “relieved this is over” and she hopes the ruling encourages other women to speak freely about their relationship experiences.
