Alan Jones trial: Man tells court broadcaster squeezed his penis in car

A man has told a court that Alan Jones touched and squeezed his penis before asking him “does it feel good” while driving the ex-radio host to his Southern Highlands farm.

Mr Jones is standing trial inside the Downing Centre Local Court where he has pleaded not guilty to 20 counts of indecent assault and two counts of sexual touching relating to six alleged victims.

Mr Jones has consistently denied the allegations that he touched the men on the penis or buttocks or kissed them.

The charges related to alleged incidents at Mr Jones’ Circular Quay apartment, his Fitzroy Falls farm, at his work premises, the Gunners Barracks restaurant at Mosman and at social functions across Sydney between 2003 and 2020.

Mr Jones’ legal team includes barristers Gabrielle Bashir SC, Michael Burke and Claire O’Neill, as well as solicitors Bryan Wrench and Chris Murphy.

In her opening arguments, Ms Bashir attacked the credibility of the complainants.

“Rivalry, treachery, double-dealing, money, hatred, desperation, opportunism and more are all at the heart of this case,” Ms Bashir said.

Crown Prosecutor Georgina Wright is presenting the Crown case.

On the first day of the trial on Monday, the first witness to give evidence is Complainant J, a former athletics champion who says Mr Jones kissed him on the mouth without his consent.

“WHAT’S THAT?”

Complainant J told the court on Monday afternoon that he did not tell anyone about the alleged kisses because he was “scared” he would “lose everything” including the payments which he was receiving from Mr Jones.

J further told the court he was “embarrassed” and “I’d have to tell my friends and family”.

He has told the court that Mr Jones also gave him a car.

J has detailed how Mr Jones allegedly squeezed his penis while he was driving the broadcaster to his Fitzroy Falls farm in the Southern Highlands.

He has told the court that Mr Jones repeatedly nodded off during the journey and woke up in a startled state.

J told the court that Mr Jones placed his hand on his leg and then moved it up to his penis.

Complainant J told the court that Mr Jones said “what’s that?” and he replied “that’s my penis”.

J has told the court that Mr Jones replied “I thought it was your leg” and “well does it feel good”.

He has told the court that Mr Jones undid his belt and pulled his penis out of his pants during the journey and kept his hand on it for five to 10 minutes.

Complainant J has told the court that Mr Jones kissed him another two times - once while standing near the car after they arrived and once near a pig pen.

“I LOVE YOU MATE”

J has told the court that Mr Jones kissed him on another occasion inside the former Wallabies coach’s apartment.

The court has heard that the man was a champion athlete from a junior age and J said that Mr Jones sponsored him by paying him $400 a week so that he didn’t need to get a job.

He said that on one occasion he was driven to Mr Jones’ Circular Quay home, and when he was close contacted the broadcaster.

J told the court that Mr Jones replied that his coach, who drove him to the building, had to stay in the car.

He went up to Mr Jones’ apartment and was directed to his office.

J told the court that as he was leaving, he hugged Mr Jones, who said “I love you mate”. J said he also replied that he loved Mr Jones.

“When he told you he loves you, what did he do?” Ms Wright asked.

“He kissed me on the mouth again,” J replied.

“How long did that kiss go for,” Ms Wright asked.

“Half a second,” J told the court.

Asked if he consented to the kiss, J replied: “No.”

“WASN’T GIVEN AN OPPORTUNITY”

The first witness to give evidence is Complainant J, who nine of the 22 charges relate to.

Complainant J has told the court that he in 2003 he had a Chinese dinner with Mr Jones at Circular Quay before going back to his apartment at The Toaster to watch tennis.

He said that as he was getting up to leave: “he stood up and (Mr Jones) turned slightly towards me, still very close to the lounge … and that he indicated to me that he wanted a hug.”

He said that Mr Jones told him “I love you mate” and that Complainant J replied “I love you too” and “you’ve done a lot for me”.

Complainant J said that Mr Jones pecked him on the lips.

“Did you consent to being kissed on the mouth,” Ms Wright asked.

“No, I wasn’t given an opportunity,” Complainant J replied.

COMPLAINANT GIVEN ‘SMOTHERING KISS’, COURT HEARS

The court was told that “Complainant J” was a junior athlete and met Mr Jones in a professional capacity.

Mr Jones has been charged with nine alleged offences in relation to Complainant J which relate to four occasions.

It’s alleged that Mr Jones kissed the man on the mouth after having dinner and watching tennis at his Macquarie St apartment.

Crown Prosecutor Georgina Wright told the court beforehand it’s alleged Mr Jones made comments about another athlete’s penis and told him he loved him.

The court was told that for a period Mr Jones was paying the man between $400 per week, before it increased to $600 per week.

The Crown has alleged that Mr Jones touched the man’s penis as he was driving the broadcaster to his Fitzroy Falls home, the court was told.

Ms Wright told the court that Mr Jones took the man’s penis out of his pants and continued to hold it as they were driving.

After having dinner at Mr Jones’ Fitzroy Falls residence, the court was told, it’s alleged Mr Jones told the man to have a shower and to come out in a robe.

It is further alleged that after the man said he was going to bed, Mr Jones came into his bedroom wrapped his arms around him and gave him a “smothering kiss”.

The Crown has alleged that Mr Jones undid Complainant J’s robe, pulled him close and swivelled his hips so that their penises were touching.

Ms Wright told the court that the man told Mr Jones that he had never done anything like that with a man before.

Mr Jones is alleged to have then grabbed the man’s penis while he masturbated himself.

“DOWNRIGHT FICTION”

During a brief opening address, Gabrielle Bashir SC told the court that some of Mr Jones’ accusers were driven by money, while some had told “downright fiction”.

One complaint — Compliant M — has alleged that he was kissed on the mouth by Mr Jones at a sporting event.

The man was formerly a high-profile athlete, the court has been told.

Ms Bashir told the court on Monday that it will be argued that not a “soul” saw Mr Jones kiss the man at the event a in room full of people.

“M’s account simply did not happen,” Ms Bashir told the court.

“Mr Jones since day one has said he was not guilty of all these charges,” Ms Bashir said.

“Mr Jones will have the opportunity to test the evidence in the prosecution case including the credibility and the reliability of the complainants.”

COMPLAINANT ‘CORNERED’

The second complainant - Complainant C - is a man who previously worked alongside Jones.

He has alleged that Mr Jones touched him on the leg and penis as he drove him from the 2GB studios at Pyrmont and to the shock jock’s Circular Quay apartment building.

It is further alleged that Mr Jones kissed the man after cornering him in the lifts of his home and work.

“SOMEONE IN POWER”

The court has been told that complainant A was 17 when he was invited to stay at Mr Jones’ property.

The court has heard that Mr Jones had supported his family financially.

The Crown has alleged that Mr Jones put his tongue in the then boy’s mouth.

“Complainant A froze,” Ms Wright told the court.

The court has been told that the complainant gave a letter to his mother which said: “someone in power did something they should not have.”

THE ALLEGATIONS

One man alleged he was 17 when he was touched on the backside by Jones at a social function.

Ms Wright told the court during her opening address that “Complainant F” saw Mr Jones from across the room and struck up a conversation.

The Crown prosecution has alleged that Mr Jones placed his hands on his bottom and squeezed.

Complainant M was a world champion athlete who first had contact with Mr Jones from a young age when he began excelling and breaking records.

The court was told that he saw Mr Jones at a sporting function but they were sitting at different tables.

It’s alleged that Mr Jones hugged and kissed M on the corner of the mouth.

Mr Jones is also alleged to have pushed his body against M and kissed him on the mouth on another occasion inside his Circular Quay Apartment.

It’s alleged that Mr Jones touched one man on the back during a social event.

Ms Wright has told the court that “Complainant H” alleges that Mr Jones touched him on the backside at the 2019 event.

The incident made the man feeling “uncomfortable” and “helpless”, Ms Wright told the court.

“DESTROY”

Ms Bashir told that court that Complaint C had “rewritten” his history with Mr Jones.

She said that Mr Jones’ former 2GB stablemate Ray Hadley had passed on the man’s allegation to Sydney Morning Herald columnist Peter FitzSimons, which were eventually passed on to journalist Kate McClymont.

“You will see evidence in Hadley’s own words of his resolve to destroy Jones and to one by one tear his supporters apart,” Ms Bashir said.

Ms Bashir said the media was at the “heart” of the Complainant C’s allegations.

The veteran broadcaster will front a Sydney court on Monday for the start of his blockbuster trial, where he will face sexual touching and indecent assault allegations.

Mr Jones was met by a massive media scrum as he exited his black BMW and walked into court.

He refused to answer questions while being escorted inside.

Walking with a cane and wearing a navy dress jacket, Mr Jones mostly kept his head down before entering Downing Centre.

The court has previously heard that the Crown prosecution will rely on “tendency” and “coincidence” evidence during the trial.

The Crown will argue, the court has been told, that Mr Jones had a tendency to have a sexual interest in younger men and to sexually touch them in professional and social settings.

The judge-alone trial is being overseen by Judge Glenn Walsh and is scheduled to run for several months.

Police launched Strike Force Bonnefin and began investigating Mr Jones in March 2024 and he was arrested at his Circular Quay apartment on November 18, 2024.

The court has been told that 76 crown witnesses are expected to give evidence during the trial, and that “oodles” of character witnesses will be called by Mr Jones’ defence.

At one point, Mr Jones was facing 44 charges relating to 11 alleged victims.

Prosecutors have over the last year withdrawn 22 charges against Mr Jones and five complainants have dropped out of the proceedings.

Mr Jones has not fronted court since his first appearance in December 2024 following his arrest.

“These allegations are either baseless or distort the truth,” he said outside the Downing Centre Court at the time.

“I have never indecently assaulted these people.

“The law assumes I am not guilty, and I am not guilty.

“I am emphatic that I’ll be defending every charge.”
