Charlie Kirk: Prosecutors seek death penalty for alleged 23-year-old assassin of conservative activist

Damning evidence and capital punishment has been presented against the alleged assassin of controversial conservative activist Charlie Kirk.

A Utah courtroom listened on Tuesday as state prosecutors delivered damning evidence against the alleged murderer of conservative activist Charlie Kirk.

23-year-old Tyler Robinson appeared in court as Judge Tony Graf announced that prosecutors had accumulated enough evidence to reach the standard of probable cause required to try Robinson for aggravated murder as well as six related charges including felony discharge of a firearm resulting in serious injury.

Prosecution also sought permission to sentence Robinson to the death penalty if found guilty, which Judge Graf approved.

The prosecution’s case is built off Kirk’s assassination during a debate at Utah Valley University in September 2025 where he was shot from a nearby rooftop.

Kirk was the founder of conservative Christian activist group Turning Point USA, an organisation that became highly influential among conservative youth and intertwined with the Trump Administration.

He was the face of many controversial debates where critics were invited to argue with him on topics such as gay marriage and gender.

Robinson entered a plea of not guilty to all charges against him despite the evidence that prosecutors claim is overwhelmingly undeniable.

The defendant’s team attempted to withdraw the capital punishment penalty by arguing that Robinson did not put anyone besides Kirk in danger when he unloaded his firearm.

“The shooter did not miss his intended target and did not chamber another round, leaving the spent cartridge in the rifle.”

Judge Graf also denied the defence that Robinson did not act due to Kirk’s ideological views as the prosecution had proven this fact beyond probable cause.

Robinson was seen laughing with his lawyers before the hearing commenced and remained neutral throughout the day despite his mother crying from behind him.

Erika Kirk, Charlie Kirk’s widow and Turning Point USA successor was also present, releasing a statement at the conclusion of the hearing.

“Today’s decision, which comes nearly a year since Charlie was taken from us, marks an important step in our family’s pursuit of justice for him.”

The next preliminary hearing is scheduled for October 23 where an official date for Robinson’s trial is expected to be set.
