A mother falsified a DNA test and lied on her baby’s birth certificate to try to ‘derail’ the father’s legal bid to see their children, a court heard.

Southampton Crown Court heard the pair had a ‘toxic’ fouryear relationship, which ended after Saville, 25, became pregnant with their second daughter.

In messages to Mr Fitton, she had told him, ‘I’m pregnant with your second child’, but she texted his mother, with whom she still had a good relationship, saying, ‘I’m sticking to saying he’s not the dad to this one; I’ve had enough.’

After the girl’s birth in January 2022, Saville would not let Mr Fitton see her but texted his mother, admitting the two girls were ‘full blood sisters’.

When registering the birth, Saville initially left the space for the father’s name blank, but later returned to amend the birth certificate to add her new boyfriend, Danny Mellows – which the couple both signed.

Prosecutor Nick Tucker told the jury: ‘He wasn’t the father. He must have known that, and certainly Georgina Saville knew that. Knowing that Kyle was the father, she made a false declaration to Births and Deaths, knowing in so doing she would effectively be able to show [Mr Mellows] had parental responsibility whereas [Mr Fitton] would not.’ The court heard Mr Fitton ‘took it badly’ when Saville posted photos on social media of the two girls and Mr Mellows ‘as if they were a family’.

Jurors were told she was also encouraging the elder girl to call Mr Mellows ‘daddy’.

After Mr Fitton’s legal team requested a DNA paternity test, Saville, from Southampton, sent them bogus results showing the baby’s father was Mr Mellows.

Mr Tucker told jurors: ‘If taken at face value, that result might have deterred Mr Fitton from pursuing the proceedings. This was a spiteful and calculated attempt to derail his case by dishonest means.’ In July 2022, another DNA paternity test was ordered after Mr Fitton started legal proceedings over access to both children and getting his name added to the newborn’s birth certificate.

That DNA result proved that he was the father.

After being arrested, the court heard that Saville told officers that ‘biology didn’t mean anything’ and that she had provided a ‘made-up’ DNA test to ‘save herself some cost’ and get Mr Fitton ‘off my back’.

Saville denies perverting the course of public justice and a rare charge of wilfully making a false declaration as to a birth.

The trial continues.
