Kyle Sandilands has escalated his dispute with ARN, taking the broadcaster to court over the abrupt termination of his lucrative radio deal.

Proceedings were filed in the Federal Court on Friday against ARN and its subsidiary, Commonwealth Broadcasting Corporation, which holds the KIIS Sydney licence.

The legal move comes days after the network cut short Sandilands’ 10-year, $100 million contract, citing “serious misconduct” following a fiery on-air fallout with co-host Jackie O Henderson.

Sandilands is pushing back, arguing the network had no valid grounds to end the agreement.

In the filing, he claims the termination is “invalid” because there was no breach of contract or serious wrongdoing.

“The termination was unconscionable under the Australian Consumer Law,” the document states.

ARN disclosed the development to the ASX on Monday, noting the case had been lodged after markets closed last week.

“The applicants seek an order for specific performance of two contracts, payment of whatever amounts are due and payable under the contracts at the time of judgment, and damages,” the release said.

The company has signalled it will contest the claims.

“Given the early stage of the matter, ARN is unable to reliably estimate the outcome or any potential financial impact.”

The Nightly does not suggest ARN is involved in any wrongdoing.
