Perth mum jailed after forcing 3-year-old child to participate in sex acts during an affair

A mum who involved her three-year-old daughter in sexual activity with her and a man she was having an affair with has been jailed for more than 10 years.

The Perth woman, 35, pleaded guilty to 18 offences related to child sexual abuse, and was sentenced in the Western Australia District Court last week.

The court was told the woman – who cannot be identified for legal reasons – had separated from her husband of 13 years after they began experiencing sexual intimacy issues in their marriage.

The pair still lived together at their home in Perth’s north.

Her husband encouraged his wife to join Perth’s swinging community, where they met her co-offender and formed a sexual relationship with him and his wife.

The woman told her psychiatrist that tension between the four of them grew when her husband became close with the other woman.

This led to her co-offender becoming more attentive towards her and they began having an affair.

“Eventually, (he) started asking you to have sex with his daughter or your daughter … and began hounding you, and these are your words, ‘constantly to come to your house to involve your daughter in your sexual activities,’” Judge Mark Herron said in his sentencing remarks.

“Initially, you were reluctant but thought you had to agree to please him and thought that your daughter would just be in the room but would not be a participant.

“You did not believe (he) meant any harm to your daughter because he had a daughter the same age and said he wanted to be a good father to her.

“You never considered (him) to be a pedophile.”

The court was told the co-offender sent the mum a WhatsApp message asking if they could involve her three-year-old daughter in their sexual activity.

The mum arranged to go to the man’s house when her husband was away from home, noting in her messages that time was running out because her daughter would soon be aware about what was happening.

The man said in one of the messages that he “wanted to f... you next to (your daughter) and that (her daughter) could watch.”

The woman replied: “Okay” and “Bad boy.”

Footage of an incident recorded on the man’s phone showed the couple interacting with the girl at his house, which became more sexually suggestive, then they involved her in their acts.

Judge Herron said the woman’s offending was towards the worst of its kind.

“It was deliberate, planned and premeditated,” he said.

Judge Herron rejected the mum’s explanations for the offending, saying she was a willing participant and encouraged her daughter to become involved.

“(She) was clearly groomed … to believe that what was happening was normal and playful and to encourage her to become involved thinking she was simply playing,” he said.

“Your explanation, that you thought he wanted to be a good father to his daughter and would not harm (yours), is implausible in circumstances where he had discussed with you his offending against his own daughter.

“Your offending is egregious. It is towards the worst of its kind.

“(It) involves a gross breach of trust and a breach of your duty of care towards your three-year-old daughter.”

The woman must serve 10 years and nine months before she is eligible for parole.
