John Setka, former boss of CFMEU Victoria, has been arrested and charged by Victoria Police over alleged use of a carriage service to make threats.

It is understood that Mr Setka was arrested on Wednesday morning, before being hauled down to a police station where he was charged with seven counts of using a carriage server to menace.

In legal terms, a carriage service can include emails, phone calls, text messages and social media.

Mr Setka, if convicted, could face a maximum penalty for the offence, which is three years in prison.

The former CFMEU boss, who had a powerful influence over the union, stepped down from his state secretary role for the Victoria branch in July, 2024.

Since then, Mr Setka has been in an ongoing battle with the Fair Work Ombudsman over his alleged role in an attempted coercian plan involving the AFL. The Ombudsman alleged Mr Setka attempted to have the AFL throw out head of umpiring Stephen McBurney.

The Nightly has contacted CFMEU and Victoria Police for comment.
