A mother has been charged with murder after her baby was found unconscious with a blood alcohol concentration of 0.179.

Police officers were called to an Atlanta, Georgia apartment on October 14, 2025 after reports were made about an unresponsive child.

When first responders arrived at about 10.54pm, three-month old baby Nova was not breathing.

The infant was rushed to Scottish Wright Children’s Hospital, where he tragically died the following day.

Concerns about alcohol in the newborn’s system were made public in January when the Fulton County Medical Examiner’s office told police Nova’s toxicology testing uncovered a “high level of alcohol” in his blood.

“Based on these findings, the Fulton County Medical Examiner’s Office ruled the cause of death a homicide,” an Atlanta police statement reviewed by People said.

The boy’s BAC was 0.179 according to 11Alive, which is more than twice the local limit to be able to drive, and nearly four times the Australian limit of 0.05.

The outlet also said the medical examiner concluded that alcohol was in the baby’s bottle.

It is also understood that when officers arrived at the scene, Nova showed no sign of any physical injury.

After more than three months, Omayrilin Colon, Nova’s mother, was arrested on January 29 and charged over his death.

Ms Colon said she fed her son half a bottle of formula and denied giving him alcohol, according to an arrest affidavit.

She was charged with murder and first-degree cruelty to children and is being held in Fulton County Jail without bond.

The news comes after a Florida couple launched legal action against a fertility provider, alleging a devastating IVF mix-up resulted in the birth of a child who is not biologically theirs.

According to court documents, the pair claim a reproductive clinic in Orlando implanted the wrong embryo during a fertility procedure last year, leading to a pregnancy and birth involving another family’s genetic material.

The lawsuit, filed in Orange County Circuit Court, names IVF Life Inc and its lead reproductive endocrinologist, Dr Milton McNichol, as defendants. The couple allege that during an IVF transfer in April 2025, an embryo belonging to a different patient was placed in the woman’s uterus.

The pair had previously stored three viable embryos at the clinic in 2020 as part of their fertility treatment.

Those embryos were preserved for future use through in vitro fertilisation, a process in which embryos are created outside the body and later transferred to establish pregnancy.
